New Research Program for New Chemical Review

The EPA announced a new effort under the Toxic Substances Control Act (TSCA) to modernize the process and bring innovative science to the review of new chemicals before they can enter the marketplace. The Office of Chemical Safety and Pollution Prevention (OCSPP)is proposing to develop and implement a multi-year collaborative research program in partnership with the Agency’s Office of Research and Development (ORD) and other federal entities focused on approaches for performing risk assessments on new chemical substances under TSCA.

This program will refine existing approaches and develop and implement new approach methodologies (NAMs) to ensure the best available science is used in TSCA new chemical evaluations.

Key areas proposed in the TSCA New Chemicals Collaborative Research Program include:

  • Updating OCSPP’s approach using data from structurally similar chemicals to determine potential risks from new chemicals, also known as read-across. This will increase the efficiency of new chemical reviews promoting the use of the best available data to protect human health and the environment.
  • Digitizing and consolidating information on chemicals to include data and studies that currently only exist in hard copy or in disparate TSCA databases. The information will be combined with publicly available sources to expand the amount of information available, enhancing chemical reviews and enabling efficient sharing of chemical information across EPA. Safeguards for confidential business information will be maintained as appropriate in this process.
  • Updating and augmenting the models used for predicting a chemical’s physical-chemical properties and environmental fate/transport, hazard, exposure, and toxicokinetics to provide a suite of models to be used for new chemicals assessments. The goal of this effort is to update the models to reflect the best available science, increase transparency, and establish a process for updating these models as science evolves.
  • Exploring ways to integrate and apply NAMs in new chemicals assessments, reducing the use of animal testing. As this effort evolves, the goal is to develop a suite of accepted, fit-for-purpose NAMs that could be used by external stakeholders for data submissions under TSCA as well as informing and expanding new chemical categories. 
  • Developing a decision support tool that integrates the various information streams specifically used for new chemical risk assessments. The decision support tool will more efficiently integrate all the data streams (e.g., chemistry, fate, exposures, hazards) into a final risk assessment and transparently document the decisions and assumptions made. Simply put, this will facilitate the new chemicals program tracking decisions over time and evaluating consistency within and across chemistries.

EPA is holding a virtual public meeting on April 20 and 21, 2022, from 1:00 PM to approximately 5:00 PM (EDT) to provide an overview of the TSCA New Chemicals Collaborative Research Program and give individual stakeholders an opportunity to provide input.

EPA to Evaluate Air and Water Exposure Pathways Risk to Fenceline Communities

EPA has developed version 1.0 of a proposed screening level methodology that will be used to further examine whether the policy decision to exclude air and water exposure pathways from the risk evaluations will lead to a failure to identify and protect fenceline communities. TSCA requires EPA to evaluate all of a chemical’s conditions of use when conducting a risk evaluation. Under the previous Administration, the first 10 risk evaluations under TSCA generally did not assess air, water, or disposal exposures to the general population. The Biden-Harris Administration reversed this policy in June 2021.

The proposed screening level methodology uses reasonably available data, information, and models to quantify environmental releases, evaluate exposures to fenceline communities and characterize risks associated with such releases and exposures for certain air and water pathways previously not evaluated in published risk evaluations.

EPA will hold a public virtual meeting of the SACC on March 15-17, 2022, to peer review the screening level methodology. This review will ensure that the approach incorporates independent scientific advice and recommendations, and that EPA follows a transparent process. Information on registering to attend the public virtual meeting will be available in February 2022 on the SACC website.

EPA Proposes New Methane Emissions Regulation

On November 2, 2021 EPA announced it’s commitment to propose a new Clean Air Act rule to reduce methane emissions in the oil and gas sector. EPA intends to issue the supplemental proposal in 2022, and to issue a final rule before the end of 2022. Key features of the proposed rule include:
  • a comprehensive monitoring program for new and existing well sites and compressor stations;
  • a compliance option that allows owners and operators the flexibility to use advanced technology that can find major leaks more rapidly and at lower cost than ever before;
  • a zero-emissions standard for new and existing pneumatic controllers (with a limited alternative standard for sites in Alaska), certain types of which account for approximately 30 percent of current methane emissions from the oil and natural gas sector;
  • standards to eliminate venting of associated gas, and require capture and sale of gas where a sales line is available, at new and existing oil wells;
  • proposed performance standards and presumptive standards for other new and existing sources, including storage tanks, pneumatic pumps, and compressors; and
  • a requirement that states meaningfully engage with overburdened and underserved communities, among other stakeholders, in developing state plans.

ESS provides methane sampling utilizing several strategies, including EPA Method 18, Alt-100, Alt-097 – which provide several sampling options, including real-time analysis and intrinsically-safe sampling canisters.

Duke University Study Correlates Ambient Particulate Matter to Alzheimer’s Disease

ESS technician preforms preventative maintenance on a Met One Instruments, Inc. Beta Attenuation Monitoring (BAM). These monitors are used for the detection of ambient particulate matter (PM10 and PM2.5). The Met One Instruments, Inc. BAM 1022 Real-Time Portable Beta Attenuation Mass Monitor continuously measures the mass concentration of ambient particulate matter collected onto glass filter tape with a time resolution of one minute.

In a study published July 9, 2021, researchers at Duke University correlated theorized elevated rates of Alzheimer’s disease, non-Alzheimer’s dementia, and Parkinson’s disease to long-term exposure to elevated levels of ambient air particulate matter 2.5 (PM2.5) that exceed the World Health Organization (WHO) air quality standards (≥10μg/m3).

Data obtained through the State Center for Health Statistics and the Healthcare Cost and Utilization Project was evaluated against data from the Global Annual PM2.5 Grids from MODIS/MISR and SeaWiFS. The study group consisted of residents from 87 zip codes in the southern Piedmont area of North Carolina with elevated particulate matter (PM2.5≥10μg/m3). The control group consisted of residents from 81 zip codes in the same region with low levels particulate matter (PM2.5≤7.61μg/m3).

Researchers concluded that North Carolina residents aged 65+ with long-term exposures to ambient PM2.5 levels exceeding the WHO standard had significantly increased risks of death and hospital admissions for Alzheimer’s Disease.
