EPA Validates First Analytical Method for PFAS in Wastewater, Surface Water, Groundwater, and Soils.

A partnership between EPA and the DOD’s Strategic Environmental Research and Development Program has produced draft Method 1633, a single-laboratory validated method to test for 40 PFAS compounds in wastewater, surface water, groundwater, soil, biosolids, sediment, landfill leachate, and fish tissue. Until now, regulated entities and environmental laboratories relied upon modified EPA methods or in-house laboratory standard operating procedures to analyze PFAS in these settings. With the support of the agency’s Council on PFAS, EPA and DoD will continue to collaborate to complete a multi-laboratory validation study of the method in 2022. 

This draft method can be used in various applications, including National Pollutant Discharge Elimination System (NPDES) permits. The method will support NPDES implementation by providing a consistent PFAS method that has been tested in a wide variety of wastewaters and contains all the required quality control procedures for a Clean Water Act (CWA) method. While the method is not nationally required for CWA compliance monitoring until EPA has promulgated it through rulemaking, it is recommended now for use in individual permits. 

Draft Method 1633 complements existing validated methods to test for PFAS in drinking water and non-potable water.

The final rule for National Emission Standards for Hazardous Air Pollutants for Major Sources: Industrial, Commercial, and Institutional Boilers and Process Heaters: Amendments, also knows as the Boiler MACT, are due shortly.

The EPA is proposed 34 (of 90) emission limits for new and existing sources. Courts ruled that the EPA must include all boilers subcaterogized using the 10% threshold for category-defining fuel type in the MACT floor analysis. Previously the EPA excluded units utilizing less than 90% from the MACT floor analysis.

Of these 34 emission limits, 28 of the limits would become more stringent and six of the limits would become less stringent.

EPA is also proposing that facilities would have up to 3 years after the effective date of the final rule to demonstrate compliance with these revised emission limits.

The comment period on the proposed regulation ended October 23, 2020. Comments have been posted to the docket and can be found here. 

A Brief History of Boiler MACT:

On January 31, 2013, the EPA promulgated amendments to the National Emission Standards for Hazardous Air Pollutants for Major Source: Industrial, Commercial, and Institutional Boilers and Process Heaters. Environmental groups and industry filed for judicial review of the amended final rule. The court issued its decision on July 29, 2016, vacating the maximum achievable control technology (MACT) standards for all subcategories that were affected by the EPA’s exclusion of certain sources from consideration when setting the standards. The court also remanded the carbon monoxide standard to the EPA to adequately explain how carbon monoxide acts as a reasonable surrogate for organic hazardous air pollutants. On September 12, 2016, the EPA petitioned the court asking that the MACT standards be remanded without vacatur. On December 23, 2016, the court granted the EPA’s request. In November 2015, the EPA finalized its decision on certain other issues for which it granted reconsideration. Environmental groups filed a petition for judicial review of the reconsideration action. The court issued its decision on March 16, 2018, remanding for further explanation the revised 130 parts per million carbon monoxide emission limits. This final rule will address the issues that were remanded in the two court decisions.

Duke University Study Correlates Ambient Particulate Matter to Alzheimer’s Disease

ESS technician preforms preventative maintenance on a Met One Instruments, Inc. Beta Attenuation Monitoring (BAM). These monitors are used for the detection of ambient particulate matter (PM10 and PM2.5). The Met One Instruments, Inc. BAM 1022 Real-Time Portable Beta Attenuation Mass Monitor continuously measures the mass concentration of ambient particulate matter collected onto glass filter tape with a time resolution of one minute.

In a study published July 9, 2021, researchers at Duke University correlated theorized elevated rates of Alzheimer’s disease, non-Alzheimer’s dementia, and Parkinson’s disease to long-term exposure to elevated levels of ambient air particulate matter 2.5 (PM2.5) that exceed the World Health Organization (WHO) air quality standards (≥10μg/m3).

Data obtained through the State Center for Health Statistics and the Healthcare Cost and Utilization Project was evaluated against data from the Global Annual PM2.5 Grids from MODIS/MISR and SeaWiFS. The study group consisted of residents from 87 zip codes in the southern Piedmont area of North Carolina with elevated particulate matter (PM2.5≥10μg/m3). The control group consisted of residents from 81 zip codes in the same region with low levels particulate matter (PM2.5≤7.61μg/m3).

Researchers concluded that North Carolina residents aged 65+ with long-term exposures to ambient PM2.5 levels exceeding the WHO standard had significantly increased risks of death and hospital admissions for Alzheimer’s Disease.

ESS: Experts on RICE Unit Stack Testing

ESS began regularly stack testing stationary reciprocating internal combustion engines (RICE) in 2010 due to the promulgation of 40 CFR 63 Subpart ZZZZ on March 3rd, 2010. Since then, ESS has conducted over 600 stack tests on RICE engines.

The EPA has three regulations that govern stationary engines:

  • 40 CFR Part 63 Subpart ZZZZ: National Emission Standards for Hazardous Air Pollutants (NESHAP) applies to new and existing stationary compression ignition and spark ignition engines
  • 40 CFR Part 60 Subpart IIII: New Source Performance Standards (NSPS) for Stationary Compression Ignition Internal Combustion Engines
  • 40 CFR Part 60 Subpart JJJJ: New Source Performance Standards (NSPS) for Stationary Spark Ignition Internal Combustion Engines

PFAS Added to Draft Contaminate List for Water

On July 12, 2021 the EPA published a draft list of current drinking water contaminants that may occur in public water systems and are not currently regulated.  The Draft Contaminant Candidate list 5 (CCL 5) includes three chemical groups: per- and polyfluoroalkyls substances (PFAS), cyanotoxins, and disinfection byproducts (DBPs). The EPA began addressing the specific chemicals PFOA and PFOS earlier this year and has now expanded to include PFAS as a group. 

CCL 5 was developed under an improved process that included new approaches to rapidly screen a significantly larger number of contaminants, prioritizing data most relevant to drinking water exposure and the potential for the greatest public health concern, and better consideration for sensitive populations and children. EPA continues to collect data and to encourage further research on the listed contaminants to better understand potential health effects from drinking water exposure before making any regulatory determinations.
